Dating itself is not a problem, but I get the feeling it's sex you are worried about.

Age of consent for marriage for Florida:
"The age of consent is eighteen. With parental consent, parties can marry at age sixteen and parties under the age of sixteen can receive a license by reason of pregnancy or the birth of a child. However, this parental consent is not required if the minor has already been married. Common law marriage is not recognized."

Every state is different..in DE there isa four year difference that is ok (dating is ok it is being sexually active where the law comes into play).

If your 16 year old is entertaining an 18 year old, it is a problem in your eyes, I'm sure but if Florida is anything like NJ and many other states. The law is flexible becasue there is only a two year difference in ages.

Keep your enemies close would definitely apply here. If you haven't already given away that you would prefer her being with someone her age.

Is this 18 year old still in high school or not? I would encourage more interaction with the 18 year old between you and your family. If you can embrace him, he may loose his lustre in her eyes and she will dump him but if you reject him, she may be very rebellious and desire the forbidden fruit even more.

Hard as it maybe to do this. It may be the difference between having your daughter or loosing her. Draw the boy closer so you can keep an eye on both of them.

I'm confused about the legal question. What does your moral judgement tell you? Your daughter is 16. End of story. She dates who you tell her to date. I think a 16 year old girl being with an 18 year old is too far of a stretch for us. If you're looking for a legal stance then try calling your local police station or any attorney's office, or check the official state web site where you live and make some phone calls. My older kids are boys (23 & 15) and there's no way I'd allow my son at age 18 to be dating a 16 year old girl. I'd be asking them to find someone legal and their own age and maturity. When you're an adult it different to have an age gap, but for teens each year is a totally different stage and it's better that they're the same age and no more than a year apart, and once the age of 18 enters play then it's all about legallities but also maturity.

Not illegal, but if you are concerned about the nature of their relationship (abusive, inappropriately sexual, etc), she is still a minor and you could go through Child Protective Services if needed.

I am from FL and my HS boyfriend was two year older than me. He was/is a wonderful person who embraced my family wholeheartedly and they embraced him. We attended eachothers weddings, baby showers and parties. Our families remain close and our spouses have "joined" the extended family. We dated for almost three years and have long since moved-on.

It's not about age/legality, but about maturity and the nature of the relationship.

There is nothing illegal about dating, however the age of sexual consent in Florida is 18 years old, however, they would not prosecute this case because they take into consideration their close age (iluvmylife has the correct information). PS won't do anything either.
